Lake Nokomis Lake District back to board
Monday, January 9, 2012
The effort to form a lake district on Lake
Nokomis will start again following a court ruling.
Judge Mark Mangerson ruled last
month that Oneida County must re-process the Lake District petition filed by
the Lake Nokomis Concerned Citizens as if the petition was received today.
The order was delivered as a result of problems with the
audio recordings from the county board meetings where the petition was
discussed and voted upon. Mangerson found that
without the recordings the court could not make any determinations regarding
alleged impropriety of the board.
The matter will come before the Agriculture and
Extension/Land and Water Conservation Committee tonight for purposes of
updating the Committee with regards to these developments in the lawsuit and to
make plans for future hearing on the Lake District petition.
Written comments previously submitted in regard to the Lake
Nokomis Lake District petition will not be considered as the County moves
forward with the re-hearing process. Comments may be resubmitted to the Land
& Water Conservation Department of Oneida County. Interested parties can
voice their support or opposition to the Lake Nokomis Lake District petition at
a public hearing which will be set at the Committee meeting tonight.
