Homicide suspect seeks charges thrown out

The defense
is expected to seek a Wausau man's homicide charges be thrown out today.
Chase Boruch
is accused of staging his mom's death last year. Defense attorney John Voorhees
argues in court documents that criminal complaints don't show he acted with
intent to kill his mother or explain how, why, when or where she suffered the
brain injury.
Judge Glenn Hartley refused to
dismiss the case during a hearing back in February.
Boruch has been ordered to stand trial in
the death of his mother Sally Pergolski. Prosecutors
say Boruch staged the 63-year-old woman’s drowning
death in Moraine Lake on June 6, 2010, to collect on more than $1 million in
life insurance.
Voorhees also wants Hartley to throw
out evidence police took during searches of Boruch’s
and Pergolski’s homes last summer, including maps of
the lake and life insurance policies. He claims the search warrant did not show
probable cause, was overly broad and left out some key facts of the case.
But prosecutors argue that there was
evidence suggesting Pergolski’s death was intentional
and that police would find evidence related to the case in her home.
